We collect personal and company data such as first name, last name, email address, mailing address, phone number, company name, industry and title, and information about the individual’s response to marketing offers within such vehicles as advertisements, emails and websites.

How do we use the information?

We use the information to:

  • personalize marketing content to your type of business and geographic region
  • deliver marketing and events communications

What legal basis do we have for processing your information?

We rely on consent and legitimate interest of those who share their information with us.

Each email sent includes an opt-out link which allows the recipient to “unsubscribe” at any time. Recipients can follow the instructions in the footer of any email, or send a website contact form, found here, to request an opt-out from all communications or to change email topic preferences.

When do we share your information?

We do not share, sell, or rent individual personal information with anyone unless explicitly instructed by a court of law. Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you emails based on your request for information. All emails you receive from any of the Rudolph Libbe Group of companies – Rudolph Libbe Inc., GEM Inc., GEM Energy, Lehman Daman and Rudolph Libbe Properties – will come directly from the Rudolph Libbe Group, and no third party will gain access to your information.

Where do we store and process data?

Data obtained through our marketing efforts is stored and process in our email marketing management software, Act-On.  Although Act-On owns the data storage, databases and the Act-On site, the Rudolph Libbe Group retain all rights to our data. All user data uploaded to an Act-On account is stored in a personalized and secure location. Act-On will not utilize, sell, or rent the data uploaded into its system and only the Data Processor of our Act-On account may gain access to the uploaded data.

How long do we keep your data on file?

We store data for as long as we find it necessary to fulfill the purpose for which the data was collected, while also considering our need to answer your queries or resolve possible problems, to comply with legal requirements under applicable laws, to attend to any legal claims/complaints, and for safeguarding purposes.

This means that we may retain your data for a reasonable period of time after your last interaction with us. When the data that we have collected is no longer required, we will delete it in a secure manner. We may process data for statistical purposes, but in such cases, data will be anonymized.

How do we secure data?

Act-On has protected servers located in areas with security procedures, use of firewalls and implementation of other generally available security technologies. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of data, but Act-On makes no guarantee that information and data will be secure from intrusions or unauthorized release to third parties.

Use of automated decision-making and profiling

When you receive or opt-in to receive email communications from us, and you have provided your state and type of business, we may align our marketing materials to your industry type and location.  To improve the relevance of our communication to you, our software may automatically adjust the type and frequency of emails to you based on interests and information you have specified to us and your interaction with our emails and websites. Our email preference center is linked in the bottom of all outgoing marketing emails.  Recipients can either opt in to all, opt out completely or choose only individual email topics of interest.

Use of cookies and other technologies

Our software uses technologies such as cookies, tags, and scripts to monitor opens, clicks, downloads and other website page/blog activities. We receive reports based on the use of these technologies on an individual and aggregated basis.

Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our website, but your ability to use some features or areas of our website may be limited.
